Sales Policy

 

1. VIRSHETÉ offers products for sale on www.virshete.com, and its e-commerce business services are available exclusively to its end users, i.e. consumers.

 

2. Consumer refers to any individual who is acting for purposes which are outside of their trade, business or profession. If you are not a consumer, please do not buy any products on this website.

 

3. VIRSHETÉ reserves the right not to process orders received from users who are not consumers, orders received for more than 1 unit of any single product, orders made from a country different from the one that you are shipping to or to addresses to which VIRSHETÉ cannot ship, and any orders which do not comply with our policies on this Legal page.

 

4. The Terms & Conditions of Sale, in conjunction with other policies on this Legal page, govern the offer, transmission and acceptance of purchase orders relating to products on www.virshete.com, between VIRSHETÉ and the users of www.virshete.com.

 

5. These Terms & Conditions of Sale however do not govern the supply of services or sale of products by third parties listed on www.virshete.com via links, banners or other hypertext links. Every website has its own terms, conditions and policies, it is important that you read, understand and agree to the same before sending any orders and purchasing any products or services. VIRSHETÉ shall under no circumstances be deemed responsible or liable in any way for the supply of services or sale of products by third parties to the users of www.virshete.com.

 

Order Contract

 

1. When placing an order to purchase one or more products on www.virshete.com, you will be required to fill out and electronically send us an Order Request following the relevant instructions.

 

2. The Order Request contains these Terms & Conditions of Sale along with other applicable Legal policies that we advise that you carefully read before placing your order, product information per product ordered, any applicable costs and taxes, payment methods available to purchase the desired products, and information on shipping, delivery, exchanges, returns and refunds.

3. Before submitting your Order Request, you will be asked to identify and correct any possible input errors. English is the language used for executing contracts with VIRSHETÉ.

 

4. An order shall be deemed to have been submitted when VIRSHETÉ receives your Order Request electronically, and this contract will be deemed effective thereof. Once the order information has been verified as correct, VIRSHETÉ will commence with the processing of your order.

 

5. VIRSHETÉ may not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are no longer available. In the above cases, we shall inform you by e-mail that the contract has not been executed and that we have not carried out your purchase order specifying the reasons thereof. All orders placed with us are subject to the availability of such products. If the products displayed on www.virshete.com are no longer available at the time of your last access and once we have already received your Order Request, we shall inform you of the unavailability of any ordered products within 7 business days from the time that we receive your Order Request. In the case that the price of the unavailable products ordered has already been paid, the amount paid will be refunded to the same account used to make the payment. 6. By submitting an Order Request to, and making a contract with VIRSHETÉ, you unconditionally accept and undertake to observe the provisions of these Terms & Conditions of Sale, in conjunction with other applicable policies on this Legal page. If you do not agree with these Terms & Conditions of Sale, in whole or in part, please do not submit your Order Request for the purchase of any products on this website.

 

7. Once an order is placed, VIRSHETÉ will send you an acknowledgement e-mail. Please note, this acknowledgement does not mean the acceptance of your order. Your order is only accepted once the information is verified and the payment is received through your chosen payment method; after which you will receive a confirmation e-mail followed by a link that you can then use to track the status of your order.

8. A standard authorization check may be carried out on your payment method once your order is received by us. This is done solely to assure guarantees of solvency for your transaction to be carried out without any hindrance. We make our best efforts to ensure that the product descriptions and prices indicated on our website are accurate.

9. In the case of promotional codes applicable on certain or all products purchased on www.virshete.com, you may only use one promotional code per order and can only do so before sending your Order Request.

Guarantees

 

1. On www.virshete.com, we only offer products trademarked VIRSHETÉ. These products are designed and produced directly by us and/or by manufacturers authorised by us.

 

2. VIRSHETÉ does not sell second-hand products, flawed products, or products of lower quality than mentioned on www.virshete.com.

 

3. The main characteristics of each product are shown on www.virshete.com, but in instances may not exactly correspond to the real products in terms of image and/or colour due to the internet browser and/or monitor used.

 

4. Prices are subject to change and will be as quoted on our website from time to time, except in cases of obvious error. Please check the final price of sale before sending an Order Request.

 

5. Prices displayed on www.virshete.com are quoted in Indian Rupees (INR). While we try to ensure that all prices on our website are accurate, errors may occur.

 

6. Order for more than 1 unit of any single product and orders made from a country different from the one that you are shipping to, or to addresses that VIRSHETÉ cannot ship to in respect of but not limited to regulations in place, will be automatically cancelled. We shall inform you of any cancellation within 7 business days from the date that we receive your Order Request. In the case that the price of the products ordered has already been paid, the amount paid will be refunded to the same account used to make the payment. 7. All products sold on www.virshete.com​ come in appropriate packaging and with identification labels and tags attached to them. It is important that you do not remove or alter any identification labels and tags when trying on any products in the case that you may wish to exchange the same for a different size, or return the same for store credit or a refund. 8. In the unfortunate event that for some reason you receive a product that is incorrect, damaged or defective, please contact us within 48 hours from the time of delivery by writing to us here.

 

9. VIRSHETÉ hereby disclaims any guarantee of the accuracy in terms of the colour, finish and appearance of the final product as ordered by the user. The quality of any products, services, information or other material purchased or obtained by you through this website may not meet your expectations.

Payment Policy

 

1. Payment of the prices of any products ordered, including any relevant costs and taxes that may apply, if any, must be made using one of the payment methods indicated in your Order Request.

 

2. We accept most debit and credit card payments for the prices of any products ordered, which are processed using third-party payment gateways. VIRSHETÉ does not have access to, or stores any financial information, and will not use any information that you provide expect for the purposes of processing your order, including issuing refunds for any products that you may return, and for reporting fraudulent activity to the relevant authorities. Shipping & Delivery Policy

1. VIRSHETÉ offers complimentary shipping to all of India, and to most international destinations. You can order items on our website and have them shipped to an address of your choice, so long as they are made from the same country that you are shipping to, and to addresses that VIRSHETÉ can ship to in respect of but not limited to regulations in place.

 

2. Orders within India are fulfilled within 7-14 business days; international orders are fulfilled within 14-21 business days. Please note that these are estimated delivery times that are subject to change due to logistical factors outside of our control and for which VIRSHETÉ will not be responsible or liable in any way. Our logistics partner will contact you to co-ordinate the delivery of your order and the number of delivery attempts made is at their discretion.

3. All product prices indicated on this website are inclusive of any costs and taxes that may apply. For international orders, import duties may apply depending on your country. VIRSHETÉ does not collect or add this in the product prices indicated on this website. As the recipient, you are liable to clear this in order to release your shipment from customs in your country, and in which case our logistics partner will contact you with the relevant information. VIRSHETÉ insures each shipment from dispatch to delivery, after which the responsibility transfers to the recipient.

4. You may change the delivery address of your order before it has been dispatched. Once dispatched, a change of address and thereby a refund request might not be accepted.

5. VIRSHETÉ, in its sole discretion, reserves the right to cancel your order in cases where it takes longer than usual delivery times, or if the shipment is physically untraceable. VIRSHETÉ will inform you by writing in such cases and refund any amount paid in accordance with our refund policy.

Consumer Rights

 

1. If you are a consumer, you may exchange a product for a different size, or cancel your contract with VIRSHETÉ by returning products purchased on www.virshete.com for store credit or a full refund, without any penalty and without specifying any reason. To do so, you must raise an Exchange/Return Request within 7 days from the date of delivery by writing to us here.

2. Once received, we will review and follow-up on your request, and upon acceptance, schedule a suitable collection time for our authorised logistics partner to pick-up any products being exchanged or returned. Please do not make any exchange or return shipments before hearing from us. VIRSHETÉ will not be responsible, liable or obligated in such cases or in the case of shipments made using unauthorised logistics vendors, and reserves the right to reject your Exchange/Return Request.

3. Any products being exchanged or returned should not have been used, worn, washed or damaged; should still contain all attached identification labels and tags, should be retuned in their original packaging, and should be returned in the same condition in which you received them. Any gifts accompanying your order must also comply with the aforementioned and be returned. You have a legal obligation to take reasonable care of the products whilst they are in your possession. If you fail to comply with this obligation, or if the product code, any if applicable, does not match with VIRSHETÉ’s records, or if VIRSHETÉ is satisfied that the product has been rendered defective or unusable, VIRSHETÉ reserves the right to reject your Exchange/Return Request.

 

4. If you raise the Exchange/Return Request within 7 days from the date of delivery to you, and return the products in the same condition in which they were received using an authorised logistics partner, we will process any refund due to you, or store credit as may be applicable, as soon as the products being returned have been received by us and have successfully passed all quality control checks. VIRSHETÉ will refund the price of the products being returned in full, or store credit as may be applicable, within 10 business days from the day that the products being returned have been received by us.

 

5. Exchanges and returns within India are free of cost. For international orders, we only accept exchanges and returns in the unfortunate event that you receive an incorrect, damaged or defective product, and for which you will be required to provide evidence, such as pictures for example. In this case, you must notify us within 48 hours from the time of delivery by contacting us here. We will review and follow-up on your request, and upon acceptance, you may opt for any one of the following options:

a. Have a new piece of the same product delivered to you in accordance with our Shipping & Delivery policy.
b. Store credit, which allows you to shop for the same amount on www.virshete.com.
c. A full refund credited to the same account used to make the purchase. Please allow for up to 10 business days for the refund to reflect in your account.

6. The cancellation right set out herein does not apply to sealed products unsealed by you following delivery, products that are deemed unsuitable due to health protection or hygiene reasons such as innerwear, products made to your specifications or are clearly personalized, or products which have become inseparably mixed with other items after delivery. If a product does not qualify for an exchange or return, the same will be mentioned on the product's page.

Errors

 

1. In the unfortunate event that you receive an incorrect, damaged or defective product, you must notify us within 48 hours from the time of delivery by contacting us here, and for which you may be required to provide evidence, such as pictures for example. We will review and follow-up on your request, and upon acceptance, schedule a suitable collection time for our logistics partner to pick-up any products being exchanged or returned due to error on our part, and bear any costs associated with such cases. Please do not dispatch any exchange or return shipments before hearing from us. VIRSHETÉ will not be responsible, liable or obligated in such cases or in the case of shipments made using unauthorised logistics vendors, and reserves the right to reject your Exchange/Return Request.

 

2. Any products being exchanged or returned due to error on our part should not have been used, worn, washed or damaged; should still contain all attached identification labels and tags, should be retuned in their original packaging, and should be returned in the same condition in which you received them. Any gifts accompanying your order must also comply with the aforementioned and be returned. You have a legal obligation to take reasonable care of the products whilst they are in your possession. If you fail to comply with this obligation, or if the product code, any if applicable, does not match with VIRSHETÉ’s records, or if VIRSHETÉ is satisfied that the product has been rendered defective or unusable, VIRSHETÉ reserves the right to reject your Exchange/Return Request.

 

3. VIRSHETÉ will examine all products being returned as incorrect, damaged or defective and will confirm to you via e-mail that you are entitled to a refund for the incorrect, damaged or defective products within 7 business days from the date that we receive the products being returned. Subject to acceptance by VIRSHETÉ of the incorrect, damaged or defective products, VIRSHETÉ will refund the price of the products being returned in full, or store credit as may be applicable, within 10 business days from the date that the products being returned have been received by us. In the event that VIRSHETÉ finds no fault with the returned products, you will be notified that the returned products cannot be accepted and you may elect to have the products re-delivered to you at your expense. If you do not accept re-delivery, VIRSHETÉ reserve the right to retain the products and the purchase price, and recover any fees and expenses incurred from you.

 

4. If the recipient of the products indicated in the Order Request is different from the individual who made the payment for the products, the amount paid for products being returned will be refunded by VIRSHETÉ to the individual’s account used to make the payment, or the account indicated in the Exchange/Return Request, unless you have expressly agreed otherwise. The value date for the credit shall be the same as the value date of the original debit, and consequently you shall not suffer currency exchange or interest losses.

 

5. Upon acceptance, VIRSHETÉ will refund the price of the products being returned within 10 business days from the date the products being retuned are received by us. To the extent permitted by applicable law, VIRSHETÉ will not be responsible or liable for any delay of any kind that is beyond its control, including but not limited to delays caused by the payment method used to process your purchase or refund, or by our logistics partners.

 

Liability

 

VIRSHETÉ will not be responsible or liable for any special, incidental, indirect or consequential damages of any kind in connection with this contract, even if VIRSHETÉ has been informed in advance.

 

Governing Law

 

The Terms & Conditions of Sale outlined in this agreement, along with any applicable contractual obligations outlined on this Legal page between VIRSHETÉ and its consumers, are governed by Indian law, subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
